Terms of service
Template — have it reviewed by a lawyer. This text describes the actual service but is not a substitute for individual legal advice.
1. Provider and scope
These terms apply to all paid services provided by Paweł Dziura Działalność Ogólna, ul. Warszawska 40/2A, 40-008 Katowice, Polen (the “provider”). The free single-page check is provided free of charge and does not constitute a contract.
2. What the service is
The provider supplies a fully automated check of websites against WCAG 2.1/2.2 Level AA (engine: axe-core 4.12). Services: a one-time site report (€14) and recurring monitoring (€14 per month or €140 per year). No manual human review is performed.
3. No guarantee of compliance
Automated testing catches only part of WCAG issues (studies range roughly 30–57% by method). The provider owes the execution of the automated scan and delivery of the report — not the achievement of accessibility or legal compliance under BFSG/EAA. Reports are not legal advice and not a certification.
4. Contract and payment
The contract is formed when the provider confirms the request. Billing is by invoice; there is no self-serve checkout at this time. Prices are exclusive of VAT where applicable. Monitoring plans run until cancelled; cancellation by email takes effect at the end of the current billing period.
5. Customer obligations
The customer warrants they are authorised to have the specified website scanned. Only publicly reachable pages are checked.
6. Liability
The provider is fully liable for intent and gross negligence and for injury to life, body or health. For ordinary negligence, liability is limited to breaches of material contractual duties and to typical, foreseeable damage. Liability for fines, cease-and-desist claims or third-party claims arising from the accessibility of the customer’s website is excluded.
7. Right of withdrawal (consumers)
Consumers have a statutory 14-day right of withdrawal. For digital services it lapses once the provider has begun performance with the consumer’s express consent before the period ends and the consumer has acknowledged the resulting loss of that right.
8. Final provisions
German law applies. If individual provisions are invalid, the remainder stays in force. Contact: contact@klar-barrierefrei.de.
